Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Offerzy ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Eligibility

You must be at least 18 years old to use Offerzy. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information during registration
• Keeping your profile information up to date

You may sign in using Apple, Google, or email/password. You must not share your account or create multiple accounts.

4. Listings & Transactions

Sellers are responsible for the accuracy of their listings, including descriptions, photos, and pricing. Offerzy acts as a platform to connect buyers and sellers and is not a party to any transaction. All sales are between the buyer and seller directly.

You agree that:

• All listing information is accurate and not misleading
• You have the legal right to sell the items you list
• Prices are fair and clearly stated in Indian Rupees (INR)
• AI-generated listing details are reviewed and confirmed by you before publishing

5. Prohibited Items & Activities

You may not list or sell:

• Illegal, stolen, or counterfeit goods
• Hazardous materials or weapons
• Drugs, tobacco, or alcohol
• Items that infringe intellectual property rights
• Adult or sexually explicit content
• Any item prohibited by applicable Indian law

Offerzy reserves the right to remove any listing at its sole discretion.

6. User Conduct

You agree not to:

• Harass, threaten, or abuse other users
• Post spam, misleading, or fraudulent content
• Attempt to scam or deceive buyers or sellers
• Use the App for any unlawful purpose
• Interfere with the App's operation or security
• Collect personal information of other users without consent

Violation of these rules may result in account suspension or permanent termination.

7. Content Moderation & Reporting

Offerzy provides mechanisms for users to report objectionable content and block abusive users. When you report content or a user:

• Our team reviews all reports promptly
• Reported content may be removed at our discretion
• Blocked users are prevented from contacting you and their content is hidden from your feed
• Repeated violations lead to account termination

8. AI-Generated Content

Offerzy uses artificial intelligence (Google Gemini) to generate listing titles, descriptions, and price suggestions based on photos you provide. These are provided as recommendations only. You are solely responsible for reviewing, editing, and confirming all AI-generated content before publishing a listing.

9. Intellectual Property

All content, design, branding, and technology in the Offerzy app are owned by Offerzy. You retain ownership of content you upload (photos, descriptions) but grant Offerzy a non-exclusive, worldwide, royalty-free licence to display, reproduce, and distribute your content on the platform for the purpose of providing our services.

10. Privacy

Your use of Offerzy is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

11. Disclaimer of Warranties

Offerzy is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. We do not verify the identity of users, the quality of listed items, or the accuracy of listings.

12. Limitation of Liability

To the maximum extent permitted by law, Offerzy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use the App
• Any transactions between users
• Any disputes between buyers and sellers
• Unauthorised access to your account
• AI-generated content inaccuracies

13. Indemnification

You agree to indemnify and hold harmless Offerzy, its officers, directors, and employees from any claims, losses, or damages arising from your use of the App, your violation of these Terms, or your violation of any rights of another user.

14. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through the App settings. Upon termination, your listings will be removed and your personal data will be deleted in accordance with our Privacy Policy.

15. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of Offerzy shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.

16. Changes to Terms

We may update these Terms from time to time. We will notify users of significant changes through the App. Continued use of Offerzy after changes constitutes acceptance of the revised Terms.
